What a missing year costs
If you are owed a refund
There is no penalty for filing late when the return shows a refund. There is a deadline: a federal refund has to be claimed within three years of the original due date, or the Treasury keeps it. A 2023 return was due April 15, 2024, so its refund is gone after April 15, 2027.
If you owe
Two penalties stack. Failure to file runs 5 percent of the unpaid tax for each month late, up to 25 percent. Failure to pay runs 0.5 percent a month. Interest accrues on the tax and on the penalties. Filing stops the larger penalty from growing even if you cannot pay yet, and an IRS payment plan can cover the balance.
If the IRS already filed one for you
When the IRS has income records for a year with no return, it can prepare a substitute for return. That version treats you as single or married filing separately, allows no business expenses, claims no dependents, and turns into a real bill. Filing an accurate return for the year usually replaces the IRS figure with the correct one.
How many years back to file
IRS policy is generally to ask for the last six years of returns before treating someone as back in compliance, although it can ask for more. There is no time limit on assessing tax for a year with no return, because the three-year clock only starts once a return is filed. A missing federal year is usually a missing Colorado year as well, and the state return gets caught up alongside it.
Getting records for old years
Missing W-2s and 1099s keep a lot of people from starting. The IRS keeps wage and income transcripts showing what employers, banks, and brokers reported, and an IRS online account shows up to the last ten years of them. That usually covers income. Expenses and deductions take receipts, bank statements, or mileage logs, and we will tell you which ones are worth hunting down for each year.
Returns for the current year and the two before it can be e-filed. Anything older is printed, signed, and mailed, one year per envelope.
Amending a return you already filed
Form 1040-X corrects a filed return: a 1099 that arrived late, a dependent left off, a credit you did not know you qualified for, or a corrected form from a brokerage. You generally have three years from when you filed the original, or two years from when you paid the tax, whichever is later, to claim money back. Amended returns for recent years can be e-filed.
The IRS says to allow 8 to 12 weeks to process a 1040-X, and up to 16. Where's My Amended Return on irs.gov tracks it. A federal amendment that changes your income almost always needs a matching amended Colorado return.
Questions about back taxes
How far back can I file taxes?
You can file a return for any past year. The IRS generally asks for the most recent six to consider you current, and a refund can only be claimed for roughly the last three.
Do unfiled taxes ever go away?
No. The IRS has no deadline for assessing tax on a year when no return was filed. Its ten-year limit on collecting a balance only begins once the tax has been assessed.
Can I e-file a prior-year return?
For the current year and the two years before it, yes. Older returns are printed, signed, and mailed.
Should I amend my return for a small mistake?
The IRS corrects math errors on its own and will write to ask for a missing schedule, so those do not need a 1040-X. Amend when your income, deductions, credits, or filing status were wrong.
